The relationship between parents and their children can sometimes become strained with the arrival of grandchildren. Grandparents then find themselves excluded from their lives and may need to turn to the courts to enforce their rights, including visitation rights. Here are some experiences and advice.

Family relationships can become so fraught and complicated that the birth of a child, who is a grandchild, can intensify conflicts. This new family member becomes another reason for confrontation, as parents deny grandparents any involvement in the child’s life. “I used to look after my 4-year-old granddaughter every day, and then suddenly, nothing. I haven’t even seen the youngest who’s now 12 months old“, laments a user on the Women’s Journal forum, unsure how to reconnect with her son.

Sometimes, parents with “family issues” may “hold hostage” their children by keeping them from visiting their grandparents during vacations or Christmas holidays, for instance. “My son blackmails me: he lets me see my two-and-a-half-year-old granddaughter, then nothing for several months“. What can be done in such situations? What rights do grandparents have when they feel powerless and deprived as relationships deteriorate? How can they move forward when they sometimes perceive these actions as “emotional punishments”?

What Rights Do Grandparents Have?

When relationships break down, some parents resign themselves to building their lives without dwelling too much on the issue. “For my part, it’s been almost 18 years since I last saw my only son. In 2011, I tried to reach out to him on social media, but to no avail. I’ve remade my life and found a wonderful stepson“, shares a family man. “I no longer try to contact him, because life goes on and I won’t make myself sick over it“, he adds. But others fight to assert their rights. How to proceed? Before initiating a legal procedure, it’s advisable to seek an amicable settlement because “legal proceedings are lengthy, costly, uncertain, and often traumatic and painful for the entire family“, warns the School of European Grandparents, which recommends judicial proceedings as a last resort. To this end, they can turn to a family mediator (or even a friend or family member) to find common ground. There’s also the option of a conciliator, whose mission is to resolve the conflict.

If no compromise is reached and familial relationships are severed, legal action may be pursued with an attorney. The family affairs judge at the judicial court located in the grandchildren’s residence must then be approached. The judge may interview the grandchildren to gauge their perspectives. Subsequently, he or she will decide whether to grant visitation or custody rights.

– The right of visitation allows grandparents to spend time with the child during the day.

– The right of accommodation permits them to invite the child to stay overnight.

– The right to correspond facilitates the exchange of letters, phone calls, and emails to maintain contact.

– The right to personal relationships enables grandparents to participate in the child’s upbringing, as long as they do not replace the parents.

Under what circumstances can a judge deny grandparents the right to see their grandchildren? Incapacity, alcoholism, harshness of the grandparents, and even the grandchildren’s refusal are some of the factors that can prompt the family affairs judge to suspend this relationship. Whether the parents are married, separated, divorced, or whether the child is adopted or not, the child’s rights remain consistent.

What the law states. Since 2007, a law allows the young and the elderly to maintain a connection, despite the parents’ wishes. If the child wants to see their grandparents, it’s their right. According to Article 371-4 of the civil code, “the child has the right to maintain personal relationships with his ascendants. Only the child’s interest can obstruct the exercise of this right. If it is in the child’s interest, the judge of family affairs sets the terms of the relationships between the child and a third party, parent or not“. However, this law is sometimes enforced to the detriment of the parents. Indeed, it can happen that grandparents use their rights to exert legal, psychological, or financial pressure on families. According to the association The Drift 371-4, “allowing grandparents (or third parties), regardless of their behavior, the possibility to resort to the courts to obtain, against the parents’ will, a right of visitation and/or accommodation of the grandchildren is unnecessary and dangerous”. The Role of Grandparents

Too present, too intrusive… Children sometimes feel that their own parents interfere too much in their family lives, especially when they judge or advise on how to raise their children. Indeed, they can sometimes be overbearing or guilt-inducing by offering their advice: “Don’t do it that way, you should teach him to be more careful, etc.” They may also be appalled by the parenting provided by the parents, simply because mentalities and educational recommendations evolve over time. However, they should not educate, specifies the School of European Grandparents. It is therefore crucial to clarify the role that grandparents should play, namely that of transmission: of life values, morality, or even the sensory experience of foods. They also have a role to listen and share with the child (spending time with him, welcoming him), with the responsibility, when the child confides in them, to encourage him to talk to his parents, in order not to break this bond of confidentiality.

How to Avoid Conflicts with Children?

To defuse disputes, communication, mutual respect, and good understanding are essential. Also, grandparents must show tact, especially from the birth. Holding the baby in the maternity ward room without being invited, or making remarks about baby care, can indeed harm the good relationship between parents and grandparents. Everyone should maintain their role. Also, do not hesitate to discuss things together when you feel a chill in the family, in order to resolve issues calmly. Finally, there’s no need to take each other’s place since everyone’s presence is essential for the child. Do you feel that your grandchildren do not visit often enough? Remember that your children are probably very busy. So, avoid reproaching them and instead organize a fun afternoon at home to bring all your children and grandchildren together in a good mood.

What Solutions Exist to Regularly See Your Grandchildren?

Grandfather, grandmother: if you want to become indispensable in the lives of your grandchildren, and see them on a weekly basis, there is a solution that can bear fruit and will greatly relieve parents: offer to take care of the extracurricular activities! Taking the grandchildren to dance, drawing, or violin lessons will be an opportunity to enjoy exclusive moments with them, knowing that the trips are conducive to confiding. Then take advantage of a snack break to extend your time together, and enjoy special moments with your descendants. This is a good compromise for everyone: parents will be pleased to be relieved of these time-consuming tasks, you won’t be accused of being too intrusive in the family life, and you’ll have the chance to create a real appointment with your grandson or granddaughter, who will look forward to it just as much as you!

And if you really want to push sharing to the limit, sign up for intergenerational activities, such as learning chess, reading workshops, or scrapbooking. Mom and dad won’t be able to do without you!
